Fees

Judith usually offers a first free consultation of 30 minutes per client. Thereafter, Judith will set a fixed fee at the outset which is based on an hourly rate which is currently £200+VAT (if applicable). How she calculates the fee will be determined by the amount of time she considers necessary to complete your application, the amount of hours depends on the number of documents, whether they need to be translated, whether anything is missing and how long it will take to obtain the missing documents. Disbursements are not included in the costs set out below and are addressed further down this page.

The figures given below are typical fees for each type of case but should only be considered as a guide and do not include VAT. Fees may be subject to VAT. VAT on immigration matters is complicated and dependent on whether you are resident in the UK for tax purposes rather than your immigration status or application type. Judith will only be able to confirm your VAT liability in relation to fees and disbursements upon taking specific instructions from you and before proceeding with the matter. If you are liable to pay VAT, it will be added to the firm’s fees and any other expenses which are subject to VAT. The current rate of VAT is 20%.

Applications for Judicial Review These cases vary considerably and fees can only be advised following a preliminary discussion, as a guide the cost is likely to be between £1500-£3000 excluding barrister's fees and Court fees. These costs are "at risk" which means that the unsuccessful party usually pays the legal costs of the successful party.

On average in a straightforward case, this type of application takes around 5 hours and this is how the fee is calculated. The fixed fee of £1000 is based on Judith’s hourly rate of £200.

The exact number of hours it will take depends on the circumstances in your case such as:

  • The amount of supporting evidence that needs to be considered
  • Which language(s) you speak
  • Whether you are applying with other dependants

If you are able to provide sufficient evidence at our first meeting and clearly meet the applicable Immigration Rules, the cost is likely to be at the lower end of the range quoted in the price list.

The work will involve:

  • discussing your circumstances in detail and confirming whether this is the most appropriate application for you to make and what other options may be available to you;
  • giving you advice about the requirements of the Immigration Rules and whether you meet the criteria.
  • if you do not fulfil certain criteria, whether this can be overcome and how.
  • considering the supporting evidence you have provided.
  • advising and where necessary helping you obtain further evidence (such as medical records and bank statements), including taking statements of any witnesses;
  • preparing your application ready for submission by your chosen method
  • Attendance at a Home Office interview: if the Home Office ask you to attend an interview, I will give you clear advice (and discuss the possibility of us attending with you) at the appropriate time.
  • giving you advice about the outcome of the application and any further steps you need to take.

What services are not included in the fixed fee:

The costs quoted above do not include disbursements which are costs related to your matter that are payable to third parties, such as visa fees. We handle the payment of the disbursements on your behalf to ensure a smoother process. If VAT is due, it is charged at 20%. These additional costs include:

  • Interpreters / Translation fees at £20 per hour and £25 per page.
  • Independent expert reports e.g. medical experts. These are not required in many cases: I will let you know as soon as possible if I consider an expert report is necessary.
  • Barrister's fees to represent you at Court.
  • Court fees.
  • Any Home Office fees for making the application. You will pay this to the Home Office directly as part of the application process.
  • Where the Home Office refuse your application, advice and assistance in relation to the merits of an appeal.
  • Representing you at an appeal against a decision to refuse your application and / or challenge a decision by way of judicial review.

Timescales

We cannot guarantee how long the Home Office will take to process your application but will give you an indication based on the Home Office current timescales which can be found here - Read the current processing times.

Provided it is the appropriate time to submit an application, we will normally be able to submit this type of application within 1 week of you instructing us provided you have all the necessary documents ready, if more evidence is necessary then the application will usually be submitted within a week of receipt of all outstanding evidence.
